Vital Notice to Users

KORBAN IS A NON-CUSTODIAL SOFTWARE INTERFACE.

These terms include several especially important provisions that affect your rights and responsibilities, including but not limited to (1) the disclaimers in Section 11, which limit the Operator's legal liability, (2) your agreement to reimburse the operator for problems caused by your misuse of the Services in Section 12, and (3) an agreement about how to resolve disputes in Section 14 via binding individual arbitration.

01Scope of Services

These Terms of Service ("Terms") govern your access to and use of the Korban mobile application, website (www.korban.app), and associated technical infrastructure (collectively, the "Services"). Korban is operated by Korban Trading LTD (the "Operator", "we", "us").

The Services provide a visual user interface intended to facilitate interactions with the Hyperliquid protocol and other third-party decentralized protocols (the "Protocols"). The App is a visual representation of underlying smart contracts deployed in a permissionless manner on public blockchains.

"The Operator has not deployed any of the underlying smart contracts which the App's visual representation allows users to view. These smart contracts exist on third-party blockchains and are entirely permissionless to access."

02Non-Custodial Architecture

Korban is strictly non-custodial. We do not create hosted wallets, nor do we custody digital assets on your behalf. Any digital assets you acquire through the usage of the App are held and administered solely by you via your own protocol-compatible wallet address.

Secure Infrastructure: Your private key(s) are secured using Turnkey's secure infrastructure. Turnkey provides advanced cryptographic isolation and Trusted Execution Environments (TEEs) to ensure that your keys remain under your ultimate control. By using our Services, you acknowledge that Turnkey is an independent provider with its own security protocols.

CRITICAL: TURNKEY AND KORBAN NEVER HAVE ACCESS TO YOUR UNENCRYPTED PRIVATE KEYS. WE CANNOT RECOVER LOST SEED PHRASES OR KEY MATERIAL. IF YOU LOSE ACCESS TO YOUR DEVICE AND RECOVERY METHODS, YOUR ASSETS MAY BE PERMANENTLY UNRECOVERABLE.

03Eligibility and Prohibited Jurisdictions

By accessing or using the Services, you represent and warrant that you are at least 18 years of age and have the full legal capacity to enter into these Terms.

Strictly Prohibited Regions

You may not use the Services if you are a citizen, resident, or organized in any of the following:

04Exhaustive Risk Disclosure

Protocol Risk/01

Underlying smart contracts may contain vulnerabilities, bugs, or logic errors that could result in total loss of assets.

Market Volatility/02

Digital assets are subject to extreme market fluctuations. High-leverage trading carries significant liquidation risk.

Custodial Chain/03

Korban relies on third-party infrastructure (Turnkey, Blockchain RPCs). Failures in these systems are beyond our control.

Regulatory Uncertainty/04

Blockchain regulation is evolving rapidly. Future laws may restrict or prohibit the use of our interface in your region.

05Fees and Transactions

Using the Services may require you to pay fees to the Operator or to third-party protocols (e.g., gas fees on Hyperliquid/Arbitrum).

/Interface Fees: Korban may charge a convenience fee for certain swaps or trades, which will be disclosed in the UI.
/No Refunds: All blockchain transactions are final and immutable. We cannot reverse, cancel, or refund any transaction.

06Acceptable Use policy

You agree not to engage in any of the following prohibited activities:

Market manipulation (Wash trading, spoofing)

Exploiting protocol vulnerabilities

Automated scraping or bot-interaction without API approval

Laundering illicit funds

Bypassing geographical IP restrictions (VPN usage for restricted regions)

Impersonating Korban staff or entities

11Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE OPERATOR EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THE OPERATOR MAKES NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS; THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE.

12Limitation of Liability

IN NO EVENT SHALL KORBAN TRADING LTD, ITS AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICES.

OUR CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO THE OPERATOR IN THE LAST THREE MONTHS, OR $1,000 USD, WHICHEVER IS LESS.
